Welcome to Tubbs Desserts Ltd (“Tubbs”, “we”, “our”, “us”). These Terms explain how you may access, use and purchase through our website, store and related services (the “Services”). By visiting or purchasing from Tubbs, you agree to these Terms, our Privacy Policy, Delivery Policy, and Returns & Refunds Policy.
1. Eligibility & Accounts
You must be the age of majority in your country of residence to use our Services.
You agree that all information you provide (including email, billing, delivery and payment details) is accurate and up to date. You are responsible for keeping your account secure.
2. Products & Information
We aim to display our products accurately, but colours, photography and appearance may vary by device or packaging.
Product descriptions, pricing, ingredients, allergens and availability may change without notice.
We may limit quantities or discontinue flavours, particularly small-batch or seasonal items.
3. Orders & Acceptance
Your order is an offer to purchase. We accept your order when payment is authorised and you receive an order confirmation email.
Please check your order carefully before submitting. Cancellations may not be possible once accepted or prepared.
Orders are governed by our Delivery Policy and Returns & Refunds Policy.
4. Frozen Goods
Our ice cream, gelato and sorbet are frozen and perishable. Because they deteriorate rapidly once thawed:

the Consumer Contracts Regulations 2013 cooling-off period does not apply
-
products cannot be returned
-
refunds or replacements are only available where items are faulty, incorrect, damaged, or arrive melted following a successful, on-time delivery attempt
Purchases are for personal or household use only unless agreed in writing.
5. Delivery & Missed Deliveries
Deliveries are handled in accordance with our Delivery Policy, which forms part of these Terms.
5.1 Delivery windows
Delivery currently takes place on Fridays and Saturdays.
You will be allocated an AM window (10:00–13:00) or PM window (13:00–16:00) based on your postcode and route planning.
Delivery window times are best estimates and may vary due to traffic or operational factors.
5.2 Customer responsibilities
Because our products are frozen, you agree to:

ensure someone is home to receive the order
-
transfer the products to a freezer immediately
-
provide accurate address and access instructions
-
notify Tubbs by 8 a.m. if you need to rearrange your delivery
We cannot leave deliveries unattended or in a safe place unless pre-authorised in writing before dispatch.
5.3 Delivery attempts

We will make one delivery attempt within your allocated window.

If unsuccessful, you may request one further attempt in the next available Friday or Saturday AM/PM slot.

If both attempts are unsuccessful, the order will be marked as fulfilled and cannot be refunded.
5.4 Transfer of risk
Risk transfers to you when:

you (or your authorised recipient) receive the order, or
-
you refuse delivery, or
-
the delivery attempt is unsuccessful due to no one being home, incorrect details, or lack of access
Once risk has transferred, melting or deterioration is not eligible for refund.
6. Pricing, VAT & Payments
Prices are in GBP (£) and include VAT unless stated otherwise.
Prices may change at any time. The price confirmed at checkout is final.
Payments are processed securely by Shopify Payments (Stripe) and other approved providers.
These providers process your data under their own privacy notices.
7. Intellectual Property
All trademarks, designs, logos, images, recipes, text and branding belong to Tubbs Desserts Ltd or our licensors.
“TUBBS®”, “Tubbs Desserts™” and the Tubbs “U” logomark are trademarks of Tubbs Desserts Ltd.
You may not reproduce or use any materials without permission.
8. Third-Party Tools & Links
We may provide links or access to third-party tools. These are provided “as is” and at your own risk.
Your use of third-party services is governed by their terms.
9. Shopify Relationship
Our store is powered by Shopify, but all orders, contracts and obligations are solely between you and Tubbs Desserts Ltd.
10. Reviews, Photos & Feedback
If you voluntarily submit reviews, comments or photography (“Feedback”), you grant Tubbs a non-exclusive licence to use this content for marketing and promotional purposes, with attribution where appropriate.
You must only upload content you own or have permission to use.
11. Errors & Omissions
From time to time, there may be errors in pricing, descriptions or availability. We may correct these or cancel affected orders where necessary.
12. Prohibited Conduct
You may not:

violate any law

infringe intellectual property
-
upload harmful code, spam or malware
-
impersonate others
-
interfere with the operation or security of the Services
We may suspend or terminate access for violations.
13. Termination
We may suspend or terminate your access at any time.
You remain responsible for charges incurred before termination.
14. Warranties
Except where required by law, the Services and products are provided “as is” and “as available”.
We do not guarantee uninterrupted or error-free operation.
15. Liability
To the fullest extent permitted by law, Tubbs Desserts Ltd is not liable for indirect or consequential losses.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any statutory consumer rights.
16. Indemnity
You agree to indemnify Tubbs Desserts Ltd from claims arising from misuse of the Services or breach of these Terms.
17. Severability
If any provision is unlawful, the remaining provisions continue in full effect.
18. Entire Agreement
These Terms, along with referenced policies, form the entire agreement between you and Tubbs.
19. Assignment
You may not transfer your rights without written permission.
We may transfer our rights to an affiliate or successor.
20. Governing Law
These Terms are governed by the laws of England and Wales.
You agree to the exclusive jurisdiction of the courts of England and Wales, subject to mandatory consumer protections in your country of residence.
21. Changes to These Terms
We may update these Terms periodically. The updated version will include a revised “Last updated” date.
Continued use of the Services constitutes acceptance of the updated Terms.
